General Terms and Conditions for online shopping on this website
LEITNER SpA, with head office in via Brennero, 34 – 39049 Vipiteno (BZ) Italy, is deemed to be the seller, and is hereinafter referred to as “LEITNER” or “SELLER”
every individual or legal entity who places an online order on the website www.leitner.com is deemed to be the buyer and is hereinafter referred to as “BUYER”.
The BUYER will be identified through the information provided on the purchase order.
Sending of the order form denotes full acceptance of the present conditions of sale by the BUYER.
1.) LEGAL BASIS
1.1. The relationship between LEITNER and the BUYER is regulated by the laws and provisions for consumer protection in force in the state where the SELLER has its registered office.
If the BUYER acts for professional or commercial purposes and provides its VAT number, the laws in force for regulation of commercial activities will apply.
2.1. LEITNER maintains a virtual online shop that gives the BUYER the ability to view and purchase the illustrated items.
3.) CONDITIONS OF SALE
3.1. The BUYER can access and purchase the individual items by following the instructions indicated in the section “Shop” on the website www.leitner.com.
3.2. LEITNER reserves the right not to deliver the ordered items should the information in the order be incorrect or incomplete.
4.1 All prices include sales tax. A sum of €6.00 will be charged for delivery of the items.
5.) EXECUTION OF THE ORDER
5.1. The order sent by the BUYER to LEITNER is not binding on LEITNER until LEITNER has received payment for the ordered items.
5.2. The order will be executed in one delivery if possible. If, due to technical or logistical reasons, partial deliveries are necessary, LEITNER will only bill the delivery fee once.
6.1. Delivery times depend on the delivery address of the BUYER. In any case, the ordered items will be delivered as quickly as possible. For first orders, the delivery time can be up to 2 weeks.
7.1. Payment has to be made via bank transfer and must always be made prior to dispatch of the items. Payment must be made to the following bank account of LEITNER AG:

8.) RIGHT TO WITHDRAW FROM CONTRACT
8.1. The right to withdraw from the contract and return the items only applies to a BUYER who purchases the items for purposes other than its commercial or professional activities. The right to withdraw from the contract does not apply to contracts between companies.
8.2. The BUYER has the right to withdraw from the contract within 14 days of receipt of the items.
8.3. To withdraw from the contract, the BUYER must notify LEITNER of its intention to withdraw by registered letter, fax or mail within 14 days of receipt of the items.
8.4. The notification must include the following information:
8.4.1 the details of the order that the BUYER wishes to cancel;
8.4.2 the explicit intention of the BUYER to withdraw from the contract;
8.4.3 the full bank account details of the BUYER.
8.5. The items have to be returned to LEITNER within 14 days of receipt.
8.6. The costs and transport risk are to be met by the BUYER. LEITNER will only accept the items if they are in their original packaging and are undamaged. If the items show traces of use or damage, LEITNER reserves the right to claim for compensation.
8.7. The amount paid for the items will be returned to the BUYER within 30 days of receipt of the withdrawal communication.
With regard to the processing of personal data, LEITNER, hereby confirms that data conveyed by the PURCHASER or received by LEITNER in the course of the work is collected in a database. This data may then be processed by employees of LEITNER AG and its affiliated companies.
“Personal data” is handled with the following objectives: implementing contractually specified relationships, trade activities, organization, statistics, compliance with legally mandated accounting and taxation reporting duties.
10.) APPLICABLE LAW AND COURT OF JURISDICTION
10.1. Any dispute between the parties in connection with the purchase agreement on the website www.leitner.com shall be governed by the law in force in the state in which the SELLER has its registered office.
10.2. If the BUYER has its registered office in a foreign country and/or purchases the items for commercial and/or professional purposes, the competent court shall be the court of the state in which the SELLER has its registered office.
By placing an order, the BUYER accepts the General Conditions of Sale on the website www.leitner.com and hereby also accepts the stipulations governing the applicable law and court of jurisdiction.
